關(guān)于法律法規(guī)標題的英譯問題，陳忠誠先生在《法律名稱之英譯》和《漢英條、法名稱中介詞使用比較》等文章中有詳細討論，他在其中提出的一些觀點很值得我們認真揣摩和借鑒。
標題是一件法律法規(guī)的靈魂所在，它高度概括了法律法規(guī)所調(diào)整或規(guī)范的對象、主要范圍或主要內(nèi)容，因此準確地翻譯法規(guī)的標題很重要（在目前的法律英文譯本中，大部分的標題都譯為 xxx Law of the People’s Republic of China 或 Law of the People’s Republic of China on xxx ）。以下討論幾個法律法規(guī)的有待完善的標題的譯法。
一、《中華人民共和國執(zhí)業(yè)醫(yī)師法》等法律名稱的譯法
目前，《中華人民共和國執(zhí)業(yè)醫(yī)師法》這部法律的名稱被譯為 “Law on Licensed Doctors of the People’s Republic of China” 。這一譯法中， “the People’s Republic of China” 直接限定 “Licensed Doctors” 。因此可以理解為這是一部關(guān)于 “ 中華人民共和國的執(zhí)業(yè)醫(yī)師 ” 的法律（這也沒錯）。誰制定的呢？譯文沒有表明。但實際上中文表述得很清楚：中華人民共和國 xx 法，是中華人民共和國制定的關(guān)于執(zhí)業(yè)醫(yī)師的法律。所以 “the People’s Republic of China” 應(yīng)該直接限定 “Law” 才更為準確（應(yīng)該不會有人 “ 叫真 ” ，說這樣一來，豈不就不明白是關(guān)于哪個國家的執(zhí)業(yè)醫(yī)師了嗎？）。在我們的很多法律和行政法規(guī)題目中，都有 “ 中華人民共和國 ” 這一限定成分，應(yīng)該說在絕大多數(shù)題目中，都應(yīng)理解為它是來限定 “ 法 ” 、 “ 條例 ” 、 “ 規(guī)定 ” 的。下面來看看幾個類似題目的譯法：
中華人民共和國法官法： Judges Law of the People’s Republic of China
中華人民共和國檢察官法： Public Procurators Law of the People’s Republic of China 中華人民共和國人民警察法： People’s Police Law of the People’s Republic of China
由此可見 , “ 中華人民共和國執(zhí)業(yè)醫(yī)師法 ” 可以譯為 “Licensed Doctors Law of the People’s Republic of China” 。據(jù)此 , 針對這類規(guī)范某種職業(yè)的法律法規(guī)的題目的特點 , 我們可以把《中華人民共和國律師法》的現(xiàn)譯 “Law of the People’s Republic of China on Lawyers” 改譯為 “Lawyers Law of the People’s Republic of China” 。這樣譯有例證嗎 ? 有。請看： Crown Attorneys Act ( 加拿大 ), Commonwealth Attorneys Act, Real Property Attorneys Act, Public Attorneys Act ( 美國猶他州 ), Patent Attorneys’ Act ( 奧地利 ) 。
二、一些標題譯法的統(tǒng)一問題
有一些法律或行政法規(guī)的題目 , 在行文格式上是完全一致的。僅就單個的題目看 , 現(xiàn)有的譯法并沒有問題 , 但當把它們放在一起時 , 就顯出了在法律法規(guī)題目的英譯方面 , 存在很大的隨意性。請看 :
中華人民共和國國籍法 :Nationality Law of the People’s Republic of China
中華人民共和國國旗法 :Law of the People’s Republic of China on the National Flag
中華人民共和國國徽法 : Law of the People’s Republic of China on the National Emblem
三部法律放在一起看 , 中文題目行文一致 , 但譯文卻作了不必要的不同翻譯 , 完全可以把《中華人民共和國國旗法》譯為 “National Flag Law of the People’s Republic of China”, 把《中華人民共和國國徽法》譯為 “National Emblem Law of the People’s Republic of China” 。再看兩個例子 :
中華人民共和國領(lǐng)海及毗連區(qū)法 : Law of the People’s Republic of China on the Territorial Sea and the Contiguous Zone
中華人民共和國專屬經(jīng)濟區(qū)和大陸架法 : Law on the Exclusive Economic Zone and the Continental Shelf of the People’s Republic of China
《中華人民共和國專屬經(jīng)濟區(qū)和大陸架法》這個題目的譯法也存在第一部分所講的問題 , 而且和《中華人民共和國領(lǐng)海及毗連區(qū)法》的譯文放在一起 , 凸顯標題翻譯的不嚴肅性。《中華人民共和國專屬經(jīng)濟區(qū)和大陸架法》可以譯為 “Law of the People’s Republic of China on the Exclusive Economic Zone and the Continental Shelf” 。 |
